In accordance with applicable European Union and Italian consumer protection legislation, customers who qualify as consumers have the right to withdraw from a distance purchase made through Rovatrix.com without providing any reason, within 14 days.
The withdrawal period expires 14 days after the day on which the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods.
Where a single order includes multiple goods delivered separately, the withdrawal period generally begins when the customer, or a designated third party other than the carrier, acquires physical possession of the last item, where applicable under the relevant legislation.
To exercise the right of withdrawal, the customer must inform:
ROIERSHUB SRL
Via Alberto Sordi, 2
81030 Lusciano (CE), Italy
PEC: roiershubsrl@pec.it
Website: Rovatrix.com
of the decision to withdraw from the contract by means of a clear and unequivocal statement before the withdrawal period expires.
The communication should include sufficient information to identify the purchase and the customer, such as:
Order number
Customer name
Description of the product or products concerned
Date of receipt of the goods
Contact details necessary to process the request
The customer may use a standard withdrawal form where one is made available, but use of such a form is not mandatory provided that the communication clearly expresses the decision to withdraw.
To meet the withdrawal deadline, it is sufficient for the customer to send the communication concerning the exercise of the right of withdrawal before the 14-day period has expired.
If the consumer validly withdraws from the contract, ROIERSHUB SRL will reimburse the payments received from the consumer in relation to the withdrawn purchase, including the cost of standard delivery where required by applicable law.
Where the consumer expressly selected a type of delivery other than the least expensive standard delivery offered by the Company, any additional delivery costs may not be reimbursed to the extent permitted by law.
Reimbursement will be made without undue delay and, in any event, within the period established by applicable consumer protection legislation.
The Company may withhold reimbursement until it has received the returned goods or until the consumer has supplied evidence of having sent the goods back, whichever occurs first, where permitted by law.
Refunds will normally be made using the same means of payment used by the consumer for the original transaction, unless the consumer expressly agrees otherwise and does not incur additional costs as a result.
After communicating the decision to withdraw, the consumer must return or hand over the goods without undue delay and in any event no later than 14 days from the date on which the withdrawal decision was communicated.
The return deadline is considered met if the consumer sends the goods before the 14-day return period has expired.
Unless otherwise stated by ROIERSHUB SRL or required by law, the consumer bears the direct cost of returning the goods.
Return instructions and, where applicable, the appropriate return address will be provided by the Company following receipt of the withdrawal request.
The consumer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics, and functioning, in the same way as would normally be permitted in a physical retail store.
Products should be returned with all items, components, accessories, manuals, and documentation originally supplied, where reasonably possible.
The absence of original packaging does not automatically result in the loss of the statutory right of withdrawal.
However, the consumer may be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
Where returned goods have suffered a reduction in value due to handling exceeding what is reasonably necessary to inspect them, ROIERSHUB SRL may be entitled to deduct an amount corresponding to that diminished value from the reimbursement, in accordance with applicable law.
Any assessment of diminished value will be made on the basis of the condition of the returned goods and the circumstances of the individual case.
The statutory right of withdrawal does not apply in cases excluded by applicable consumer protection legislation.
These exceptions may include, where relevant:
Goods made to the consumer’s specifications or clearly personalized
Goods liable to deteriorate or expire rapidly
Sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery
Goods which, after delivery, are inseparably mixed with other items due to their nature
Sealed audio or video recordings or sealed computer software that have been unsealed after delivery
Digital content not supplied on a tangible medium where performance has begun with the consumer’s prior express consent and acknowledgement, where the statutory requirements for loss of the right of withdrawal are satisfied
Services fully performed where performance began with the consumer’s prior express consent and the conditions established by law for loss of the withdrawal right are satisfied
Other goods or services expressly excluded from the statutory withdrawal right under applicable law
An exception will apply only where the relevant legal requirements are satisfied.
The right of withdrawal is separate from the consumer’s rights relating to defective or non-conforming products.
If a product is defective, damaged, or does not conform to the sales contract, the consumer may have rights under the legal guarantee of conformity, regardless of whether the 14-day withdrawal period has expired.
Consumers should consult the Warranty and Replacement Policy and Product Complaints and Dispute Resolution Policy available on Rovatrix.com for further information.
Where required by law, reimbursement following withdrawal includes the cost of the least expensive standard delivery method offered by the Company.
Additional costs resulting from the consumer’s choice of a more expensive or premium delivery option are not required to be refunded to the extent permitted under applicable consumer legislation.
Unless ROIERSHUB SRL has agreed to bear the cost or applicable law provides otherwise, the consumer is responsible for the direct cost of returning the goods.
If, because of their nature, the goods cannot normally be returned by post, information concerning the expected return cost will be provided where required by law.
The consumer remains responsible for ensuring that returned goods are appropriately packaged for transport.
The exercise of the right of withdrawal does not prejudice or replace any other mandatory rights available to consumers under Italian or European Union law.
In particular, it does not limit rights arising from:
The legal guarantee of conformity
Delivery obligations
Remedies for defective or non-conforming goods
Mandatory consumer protection provisions
Where any provision of this Policy conflicts with mandatory applicable law, the mandatory legal provision will prevail.
