Before placing the order, the User will have the opportunity to review and correct the information entered, where technically available.

Where payment has already been collected for an order that cannot be accepted, the relevant amount will be refunded in accordance with applicable law.

Where applicable, prices include VAT and other taxes unless clearly stated otherwise.

Any additional shipping or delivery costs will be shown before the User submits the order.

Available payment methods may include credit cards, debit cards, digital wallets, or other payment services made available at checkout.

Available shipping methods, applicable costs, and estimated delivery times are displayed during checkout or otherwise communicated before completion of the order.

Delivery times are estimates unless a specific binding delivery date is expressly agreed.

The User is responsible for providing accurate and complete delivery information.

The Company shall not be responsible for delays attributable to circumstances beyond its reasonable control, without prejudice to mandatory rights available to consumers under applicable law.

9. Right of Withdrawal and Returns

Consumers who purchase products at a distance may have a statutory right of withdrawal under applicable EU and Italian consumer protection legislation.

Except where a legal exception applies, the consumer may withdraw from the purchase within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

To exercise the right of withdrawal, the consumer must communicate the decision to withdraw through an unequivocal statement using the contact channels made available by the Company.

Unless otherwise required by law, products should be returned without undue delay and in any event within the applicable statutory period.

The consumer may handle the product only to the extent necessary to establish its nature, characteristics, and functioning. The consumer may be responsible for any diminished value resulting from handling beyond what is necessary for that purpose.

The right of withdrawal may not apply to products or services falling within statutory exceptions.

Further details may be provided in the Website’s dedicated Returns or Refund Policy.

10. Refunds

Where the consumer validly exercises the right of withdrawal, refunds will be made in accordance with applicable consumer law.

Unless otherwise permitted by law, reimbursement will be made using the same means of payment used for the original transaction, unless the consumer expressly agrees otherwise and does not incur additional costs.

The Company may withhold reimbursement until it has received the returned goods or until the consumer has supplied evidence of having sent them back, where permitted by law.

Any deductions from reimbursement will only be applied where legally permitted, including where the value of the goods has diminished due to handling beyond what is necessary to establish their nature, characteristics, and functioning.

11. Legal Guarantee of Conformity

Consumers benefit from the mandatory legal guarantee of conformity provided by applicable Italian and EU consumer protection law.

This legal guarantee applies independently of any additional commercial warranty that may be offered by the Company, manufacturer, or another third party.

Nothing in these Terms limits or excludes mandatory statutory rights relating to defective or non-conforming goods.

12. Promotions and Discount Codes

Promotional offers, vouchers, and discount codes may be subject to specific conditions, validity periods, exclusions, or minimum purchase requirements.

Unless otherwise stated:

  • promotional codes may not be combined;

  • codes are personal or non-transferable where expressly indicated;

  • promotions apply only during the stated validity period.

The Company may modify, suspend, or terminate promotional campaigns, subject to rights already acquired by consumers and applicable law.

Any unauthorized reproduction, distribution, modification, publication, commercial exploitation, or other use of protected content is prohibited unless permitted by law or authorized in writing by the relevant rights holder.

14. User-Generated Content

Where the Website permits Users to submit reviews, comments, photographs, or other content, Users remain responsible for the content they submit.

Users must not submit content that is unlawful, defamatory, abusive, misleading, infringing, discriminatory, fraudulent, or otherwise in violation of third-party rights.

To the extent necessary to operate, display, promote, and improve the Website, Users grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display content lawfully submitted by them, subject to applicable law and any specific terms presented at the time of submission.

The Company may moderate or remove user-generated content where reasonably necessary to comply with the law, protect third-party rights, enforce these Terms, or preserve the security and integrity of the Website.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms limits mandatory consumer rights or liability arising from fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot legally be excluded.

Subject to the above, the Company will not be liable for losses that are not reasonably foreseeable, indirect losses, or losses arising from circumstances outside its reasonable control, to the extent permitted by applicable law.

16. User Responsibility and Indemnification

Users are responsible for losses or damages caused by unlawful use of the Website or by violations of these Terms.

To the extent permitted by applicable law, Users agree to compensate the Company for claims, damages, costs, or expenses resulting directly from their unlawful conduct, infringement of third-party rights, or material breach of these Terms.

This provision does not limit rights granted to consumers under mandatory law.

17. Force Majeure

The Company shall not be responsible for delays or failures in performance caused by circumstances beyond its reasonable control, including natural disasters, strikes, transport disruptions, telecommunications failures, cyber incidents, governmental measures, or other force majeure events.

This provision does not affect mandatory consumer rights.

18. Suspension and Termination

The Company may suspend or restrict access to the Website or an account where reasonably necessary for:

  • Security reasons

  • Suspected fraud

  • Unlawful activity

  • Material violations of these Terms

  • Maintenance or technical requirements

Where appropriate and reasonably possible, Users may be informed of such measures.

Suspension or termination does not affect rights and obligations already accrued.

Those policies should be consulted for detailed information regarding the processing of personal data, cookies, tracking technologies, data-subject rights, and contact details for privacy-related requests.

20. Changes to the Terms

The Company may amend these Terms to reflect changes in applicable law, Website functionality, products, services, business operations, or security requirements.

The updated Terms will be published on Rovatrix.com.

Changes will not retroactively prejudice rights arising from contracts already concluded unless required or permitted by applicable law.

Where required, Users will be informed of material changes through appropriate means.

21. Governing Law and Jurisdiction

These Terms are governed by Italian law, without prejudice to mandatory consumer protection provisions that may apply in the country where the consumer habitually resides.

For consumers, disputes relating to purchases or these Terms shall be subject to the competent court determined by mandatory consumer protection rules, including, where applicable, the court of the consumer’s place of residence or domicile.

For Users who do not qualify as consumers, jurisdiction shall be determined in accordance with applicable law and any valid contractual jurisdiction clause separately agreed between the parties.

22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to remain valid and enforceable to the fullest extent permitted by law.

Where possible, the invalid provision shall be interpreted or replaced in a manner that most closely reflects its original lawful purpose.

23. Entire Agreement

These Terms, together with any conditions expressly incorporated by reference and any specific terms applicable to a particular purchase or service, constitute the agreement governing the User’s use of the Website.

Nothing in this provision limits mandatory rights available to consumers under applicable law.
